In this workshop mediators, managers and human resource professionals learn to diffuse situations that could mature into harassment complaints. In particular, they learn how to help workers have a facilitated discussion about conduct one or both of them might see as harassing.
Here are some of the topics we cover:
- How to triage those cases that are appropriate for non-investigative options from those that require a harassment investigation
- Pre and post investigation harassment resolution
- How to use non-investigative options in a way that preserves the workplace and the rights of all involved
- The inventory of non-investigative options that can be used to repair the situation, make the workplace whole and ensure respectful interactions
- How to use non-investigative options before the situation becomes more serious and things spiral into the need for an investigation
- How to position non-investigative options in relation to any contemplated or already conducted investigation
- How to use a facilitated discussion between a complainant and a respondent as an alternative harassment resolution strategy
- How to function as a third party conducting a facilitated discussion, including:
- How to structure the process
- How to create safe space
- How to engage the parties into the process
- How to explain your role as a third party in the process
- How to help the parties trust you and the process and want to be involved in it
- How to set the table
- How to ensure that the process is confidential and without prejudice
- How to conduct pre-session caucuses to prepare the parties
- How to bring the parties together in a joint session
- How to help each of the parties explain their perspective
- How to get the parties to talk constructively
- How to help the parties get at the core issues
